Yet another setback for the Kentucky county clerk who went to jail rather than issue marriage licenses to gay couples.
A federal judge is denying Kim Davis a stay of his order requiring her office to issue the licenses to all eligible couples who want one.
Lawyers for couples who are now suing Davis saying that since she was released from custody and returned to work, she has interfered with the issue of licenses in violation of orders from U.S. District Judge David Bunning.
Davis’ attorney says she is making a good-faith effort to comply with Bunning’s order.
She has said licenses granted by her staff in her absence are invalid because she hasn’t given them that authority. Davis refused to issue any marriage licenses since the Supreme Court ruling legalizing gay marriage across the United States, saying her beliefs as an Apostolic Christian prevent her from issuing marriage licenses to gay couples. Davis has asked Judge Bunning to put his orders on hold while she appeals the ruling, Bunning’s order specifying that his decision applied to all eligible couples, not just the couples who are currently suing Davis.
